EOHR calls for the release of demonstrators in the case of gas exportation
The Egyptian Organization for Human Rights (EOHR) condemns the kidnapping of some human rights activists before State Council in a clear violation of the right to peaceful assembly and freedom of opinion and expression guaranteed by the international covenants concerned with human rights and Egyptian constitution.

The Egyptian Organization for Human Rights (EOHR) condemns the kidnapping of some human rights activists before State Council in a clear violation of the right to peaceful assembly and freedom of opinion and expression guaranteed by the international covenants concerned with human rights and Egyptian constitution. A group of activists declared to organize a protestation attitude on Monday 4/5/2009 before State Council as an objection to export Gas to Israel, this day coincide with the verdict of the case of exporting gas to Israel, however a group of demonstrators were kidnapped during their protestation whose names are as follows: Mohamed Adel, blogger Abdullah Yahya (6th April Youth) Fouad Ibrahim (6th April Youth) Hafiz Mohammad Al Ashkar (Al Karama party) Mohamed Adib Al Karama party Mohamed Abdel Tawab Awad Rami Kamel Sayed Mohamed Mustafa Kamal Mohamed Mabrouk, reporter of Al Haya Al Youm) The mobile phone of Ali Mohamed Ali, journalist at Al Kaian Al Araby was confiscated . Also Asmaa Shawada, journalist at Al Ahaly newspaper was assaulted and thrown down from over Stat council’s stairs and arrested. EOHR condemns the deliberate attitude to prevent peaceful assemblies as it is considered a violation to the provision of Article 54 of the Egyptian Constitution which stated the right to assemble peacefully without prior permission , also a violation against article 21 of the International Covenant on Civil and Political Rights which was ratified by the Egyptian government and has become an integral part of its domestic law in accordance with Article 151 of the Constitution, also a violation to the human right to freedom and personal security guaranteed by international covenants and Egyptian constitution. Article 280 of the Penal Code banned the arrest or imprisonment or detention of persons without permission of competent authority. Also Article 40 of the Criminal Procedure code stated that “No one may be arrested or imprisoned except by the competent authorities so as to be legally treated in a manner that preserves the dignity of the human person and shall not be harmed physically or morally.” EOHR calls the legislator to amend the legislative structure which violates the right to peaceful assembly and freedom of opinion and expression, including the Illegal Assembly law No. 10 of 1914, Meetings and Demonstrations Law No. 14 of 1923, Emergency Law No. 162 of 1958. |
