Court Rejects Appeal of MB Detainees, Upholds Detention

Cairo Criminal Court on Monday September 18, 2006, rejected an appeal lodged by MB leaderships Dr. Mohamed Morsy and Dr. Essam Al-Erian who challenged a court ruling extending their detention without the two MB detainees being charged with breaching the law or constitution.

Cairo Criminal Court on Monday September 18, 2006, rejected an appeal lodged by MB leaderships Dr. Mohamed Morsy and Dr. Essam Al-Erian who challenged a court ruling extending their detention without the two MB detainees being charged with breaching the law or constitution.

The two MB leaderships were earlier on May 18, 2006 arrested at a pro judge’s demonstration and the prosecution ordered putting them in custody for two months.

The other MB members in this case were released but the two MB leaderships, along with four others, were pegged to what was known by the Prosecution as the Political Bureau Case; in this case also, all the defendants were released except Dr. Al-Eryan and Dr. Morsy.
Lawyers say that the Prosecution’s decision extending the detention of the two MB leaderships run counter to the newly enforced Law on Criminal Procedures which build cases on real charges rather than inquiries of the State Security Investigations.
Lawyer Sobhi Saleh, who heads the defense team, affirmed that the extending of the detention is aimed to prevent the two MB leaderships from voicing their opposition of the suspected constitutional amendments which will be passed during the National Party’s annual Congress slated tomorrow Tuesday.
Saleh called on the court not to be a venue for settlement of accounts between the Ikhwan and the regime.
